Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of azimuth.claims and the associated platform, applications, and services (collectively, the "Platform"), operated by Azimuth, LLC ("Azimuth," "we," "us," or "our"). By creating an account, submitting information, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Platform.

If you are using the Platform on behalf of a veteran, an organization, or as an Accredited Representative, you represent that you have authority to accept these Terms on that party’s behalf.

Azimuth is an independent technology platform. Azimuth is not a law firm, a healthcare provider, a government agency, or the U.S. Department of Veterans Affairs, and it is not affiliated with or endorsed by VA. Azimuth does not prepare, present, prosecute, or submit VA disability claims on its own behalf, and does not provide legal, medical, or financial advice.

Filing and representation are carried out either directly by the veteran through their own VA.gov session, or by an Accredited Representative acting under a signed power of attorney. Nothing on the Platform, and no action by Azimuth staff, is intended to constitute representation before VA.

Accredited Representatives - attorneys, claims agents, and Veterans Service Organization (VSO) representatives are independently accredited by VA’s Office of General Counsel under 38 C.F.R. § 14.629. They are not employees, partners, or agents of Azimuth. Using the Platform to connect with an Accredited Representative does not create any attorney-client, fiduciary, or agency relationship between you and Azimuth. Any such relationship exists solely between you and the Accredited Representative you appoint.

• You must be able to form a binding contract to use the Platform, and, if creating a veteran account, must be a U.S. military veteran or an authorized representative acting on a veteran’s behalf.
• Accredited Representatives must hold current, verifiable accreditation with VA’s Office of General Counsel and must promptly notify Azimuth if that accreditation lapses, is suspended, or is revoked.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate information and to update it as needed so your case record remains current.

The Platform organizes intake, evidence, representative matching, secure messaging, claim tracking, and appeals support into a single case record shared between a veteran and their chosen Accredited Representative. You choose your representative from those matched to you, and you may revoke a representative’s access to your case record at any time through the Platform, subject to any professional obligations your representative may separately owe you (for example, to protect a filing deadline).

Azimuth verifies representatives against VA’s OGC registry at signup and periodically thereafter, but does not guarantee the quality, outcome, or professional conduct of any Accredited Representative’s services. Disputes about representation, fees, or professional conduct are between you and your representative, and, where applicable, subject to VA’s accreditation complaint process or applicable state bar rules.

Azimuth does not charge veterans any fee, at any stage, for use of the Platform. Azimuth is compensated by Accredited Representatives and organizations, not by veterans. VSO representatives may not charge a fee for representation. Accredited attorneys and claims agents may not charge a fee for an initial claim, and any permitted appeal fees are governed by 38 U.S.C. § 5904 and 38 C.F.R. § 14.636 and must be disclosed to you in a separate fee agreement before they apply. Azimuth does not receive any portion of a representative’s fee.

You agree not to:

• Provide false information, impersonate another person, or misrepresent your veteran or accreditation status
• Use the Platform to submit fraudulent evidence or claims
• Access another user’s account or case record without authorization
• Interfere with or attempt to disrupt the Platform’s operation or security
• Use the Platform for any unlawful purpose or in violation of any applicable VA regulation governing accredited representation
• Scrape, reverse-engineer, or use automated means to access the Platform except as permitted by us

You are responsible for the accuracy and completeness of evidence and information you upload, and for having the right to submit any documents that include another person’s information. Evidence you submit is stored using encrypted storage and access to your case record is logged, as described in our Privacy Policy. Submitting information through the Platform is a core part of how the service works — the Platform is built to receive claim-related medical and service records for this purpose.

The Platform, including its design, text, graphics, software, and underlying technology, is owned by Azimuth or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, Azimuth grants you a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purpose. You retain ownership of the evidence and information you submit, and grant Azimuth a license to use it solely to operate the Platform, facilitate your representation, and as otherwise described in the Privacy Policy.

The Platform may link to third-party websites or services, including VA.gov, the VA Office of General Counsel accreditation registry, or resources maintained by partner organizations. These links are provided for convenience. Azimuth does not control and is not responsible for the content, accuracy, or practices of third-party sites, and inclusion of a link does not constitute an endorsement.

The Platform is not designed or intended for use in a medical or mental health emergency. If you are in crisis or experiencing a mental health emergency, call or text 988 (press 1 for the Veterans Crisis Line) or call 911. Do not rely on the Platform for urgent or emergency needs.

THE PLATFORM AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Azimuth makes reasonable efforts to keep the Platform accurate, secure, and available, but does not warrant that the Platform will be uninterrupted, error-free, or completely secure, or that any claim outcome will be favorable. Information on the Platform is provided for general informational purposes only and does not constitute legal, medical, or financial advice. Use of the Platform and reliance on any information provided through it is at your own risk.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AZIMUTH, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, SERVICE INTERRUPTIONS, COMPUTER DAMAGE, OR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE PLATFORM, OR YOUR RELATIONSHIP AND COMMUNICATIONS WITH ANY ACCREDITED REPRESENTATIVE.

AZIMUTH’S MAXIMUM AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL BE LIMITED TO THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE TOTAL AMOUNT PAID BY YOU TO AZIMUTH, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL; IN SUCH JURISDICTIONS, AZIMUTH’S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify and hold harmless Azimuth and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Platform, or content you submit through it.

You may stop using the Platform at any time. Azimuth may suspend or terminate your access if you violate these Terms, if your accreditation lapses or is revoked (for Accredited Representatives), or if we reasonably believe your use of the Platform poses a risk to Azimuth, other users, or the integrity of a claim. Sections of these Terms that by their nature should survive termination — including Sections 8, 11, 12, 13, and 16 — will survive.

We may modify the Platform or these Terms from time to time. If we make material changes, we will update the "Last Updated" date above and, where required by law, provide additional notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform, shall be governed by and construed in accordance with the laws of the United States and the laws of the state in which Azimuth, LLC maintains its principal place of business, without giving effect to any choice or conflict of law provisions. Any legal action or proceeding arising under or relating to these Terms shall be instituted exclusively in the federal or state courts of competent jurisdiction located in the state of Azimuth, LLC’s principal place of business, and each party irrevocably submits to the personal jurisdiction and venue of such courts.

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Azimuth regarding the Platform.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• No Waiver: Azimuth’s failure to enforce any provision is not a waiver of that provision.
• Assignment: You may not assign these Terms without our consent; Azimuth may assign these Terms in connection with a merger, acquisition, or sale of assets.
